Man Makes Plea Deal For Concealed Video Recording Charges

As part of his plea agreement, Eduardo Herrera, age 28 and a resident of Arleta, was booked at the Burbank Jail on Tuesday, February 4. Herrera was required to have his photograph and fingerprints recorded after he agreed to two misdemeanor charges of penal code 647(j)(3), the use of a concealed video recording device in an area with an expectation of privacy without the consent of the person being recorded.

Herrera was contacted by the city attorney’s office after Burbank Police were called out to Graphics One at 3300 N. San Fernando Blvd. on June 17 to investigate a concealed video camera found under the sink in the employee bathroom of the business. A female victim, age 25, discovered the device while using the restroom.

The video recordings were reviewed and showed multiple employees using the restroom at the business. Eduardo Herrera, another employee at the business, was discovered to be the person who had placed the recording device in the bathroom, according to Sgt. Darin Ryburn of the Burbank Police Department.

Burbank Police filed numerous counts connected with the unlawful video recording against Herrera with the city attorney’s office, who then sent Herrera a “Letter of Arraignment.” Herrera’s case finally went through the court system and as part of his pleading guilty to two misdemeanor charges of 647(j)(3), he was required to present himself at the Burbank Jail for booking.
